Use of the EMAS Logo

 

 

2.3. Functions of the logo in the different types of information [Article 8 and Annex IV of Regulation (EC) No. 761/2001]

 

While the first version of the logo indicates that an organization has created an environmental management system in accordance with the requirements of EMAS, the second version indicates that some specific information to which the logo has been assigned has been validated pursuant to EMAS.

 

In Article 8, paragraph 2, the EMAS regulation lists five different methods for the use of the logo:

  • for validated information, as described in Annex III, point 3.5, in the circumstances specified in this guide. In this case, the logo indicates that the information was taken from a validated environmental statement and that it complies with the requirements of Annex III, point 3.5 (second version).
  • In validated environmental statements: in this case, the participation in the system is emphasized and it is shown that the content of the declaration has been validated (second version).
  • On the letterhead of the registered organizations (first version).
  • On information material that advertises the organization's participation in EMAS: here it indicates that the organization participates in EMAS. The first version of the logo can be used, for example, for license plates, buildings, websites, invitations, etc.
  • In material that advertises products, activities and services, but only under the conditions specified in this guide, so as to ensure that there is no confusion with ecological labeling (second version).

 

In all these cases, there must be a clear link between the logo and the name of the organization.

 

Those who use the logo conferred on organizations registered with EMAS, must take care that the use of the same does not create misunderstandings among the public.
For example, the logo should not be used in a way that confuses the public or leads them to erroneous conclusions, declaring that they have done something "akin" to the EMAS regulation or in its own way to "conform" it.

 

The use of the logo in the declaration and on the headed paper is governed by the regulation (EEC) n. 1836/93 (2), but the regulation (EC) n. 761/2001 allows the use in numerous other cases, described below.
