Employee participation
1. INTRODUCTION
The legal basis for employee participation under EMAS is as follows:
Article 1 (2) of Regulation (EC) No 761/2001;
«The objective of EMAS is to promote constant improvements in the environmental efficiency of organizations through:
....
d) the active participation of employees in the organization as well as basic vocational training and adequate training to enable active participation in the tasks referred to in letter a). Employees' representatives also participate at their request ".
Annex I of the regulation (EU) n. 761/2001:
«The organization must identify training needs. It must require that all personnel whose work may have a significant impact on the environment have received appropriate training.
The organization must establish and maintain active procedures aimed at raising staff awareness at various levels and functions on the following topics:
- the importance of compliance with the environmental policy, the procedures and the requirements of the environmental management system;
- the significant real or potential environmental impacts resulting from their activity and the environmental benefits due to the improvement of their individual performance;
- their roles and responsibilities to achieve compliance with the environmental policy, procedures and requirements of the environmental management system, including preparation for emergency situations and the ability to react;
- the possible consequences of deviation from the specified operating procedures.
Personnel who have tasks that can cause significant impacts on the environment must have acquired the necessary competence through appropriate training, training and / or experience. (Annex I-A.4.2) ".
"In addition to the requirements of Annex I section A, employees must be involved in the process aimed at constantly improving the organization's environmental performance. To this end, appropriate forms of participation should be used, such as the book suggestions system or group work on individual projects within environmental committees. Organizations take into account the Commission's guidelines on best practice in this area. Employee representatives also participate at their request.
